General Terms and Conditions (GTC)

"Black Box Men" a brand of the company Pink Box AG, Ibelweg 18a - CH-6300 Zug (hereinafter referred to as "Pink Box AG") refers to a box with several changing high-end cosmetic test products, which can be ordered at www.blackboxmen.ch.

"User" refers to persons who order a Black Box Men and register with Pink Box AG.

  1. Applicability

    1. These General Terms and Conditions (hereinafter referred to as "GTC") govern all rights and obligations between Pink Box AG and the user in connection with the purchase and use of Black Box Men and are an integral part of the contract.
    2. By ordering the Black Box Men and registering with Pink Box AG, the user accepts these GTC.
    3. The user can access, print, download or save these GTC at any time, even after conclusion of the contract, at www.blackboxmen.ch.
    4. A minimum age of 16 years is required to use Black Box Men.

  2. order

    1. The offer published by Black Box Men on www.blackboxmen.ch is merely an invitation to submit an offer and is subject to change and non-binding.
    2. By clicking on the "Pay" button in the last step of the ordering process, the user submits a binding request to Pink Box AG to conclude a contract. This application is binding and irrevocable and the contract is deemed to have been concluded upon Pink Box AG's declaration of acceptance.

  3. Delivery

    1. The Black Box Men is only delivered to parcel-capable home addresses in Switzerland and Liechtenstein.
    2. At the same time as the order confirmation, Pink Box AG will inform the user of the expected delivery date of the Black Box Men.
    3. The actual delivery date may be delayed by 2-3 days.
    4. Delivery is made as an unaddressed parcel (service provider is Swiss Post or an alternative parcel delivery company). When the parcel is handed over to the user by the parcel carrier (including delivery to the drop-off box), the user assumes responsibility for the parcel.

  4. Contract term, termination, automatic renewal

    1. The Black Box Men is published three to four times a year, in spring, summer, fall and winter. When taking out a subscription (select the "Order now as a subscription" option during the ordering process on the website), the customer automatically receives the next box without having to register again.
    2. The contract can be terminated at any time up to the end of the month. Any notices of termination received will take effect from the next box issue.
    3. To terminate the contract, the customer must contact customer service via e-mail: service or telephone: 0848 00 77 77 to contact customer service. Non-payment of the bill is not equivalent to termination of the contract.

  5. Prices, shipping costs, due date and payment

    1. Prices are inclusive of VAT.
    2. Shipping costs are defined in the offer.
    3. Pink Box AG's claims are due immediately, notwithstanding any statutory right of revocation.
    4. For payment, you can only use the payment methods agreed and specified when placing the order.
    5. Reminders may include reminder fees (up to CHF 10).

  6. Liability

    1. The liability of Pink Box AG is limited to proven direct damages caused by Pink Box AG intentionally or through gross negligence. Any further liability on the part of Pink Box AG, regardless of the legal grounds, is excluded.
    2. In particular, Pink Box AG accepts no liability for damage that occurs after the Black Box Men has been handed over for dispatch or in the event of data loss or data alteration on electronic transmission channels of third parties.
    3. Furthermore, Pink Box AG is not liable for any costs incurred by the user vis-à-vis third parties in order to gain access to the services of Pink Box AG.
    4. Liability is also excluded for damages due to force majeure, such as computer viruses, power failure, strike, natural events, official orders and regulations, performance disruptions beyond the control of Pink Box AG.

  7. Privacy policy

    1. The liability of Pink Box AG is limited to proven direct damages caused by Pink Box AG intentionally or through gross negligence. Any further liability on the part of Pink Box AG, regardless of the legal grounds, is excluded.
    2. In particular, Pink Box AG accepts no liability for damage that occurs after the Black Box Men has been handed over for dispatch or in the event of data loss or data alteration on electronic transmission channels of third parties.
    3. Furthermore, Pink Box AG is not liable for any costs incurred by the user vis-à-vis third parties in order to gain access to the services of Pink Box AG.
    4. Liability is also excluded for damages due to force majeure, such as computer viruses, power failure, strike, natural events, official orders and regulations, performance disruptions beyond the control of Pink Box AG.
    5. Pink Box AG may use your data for advertising/marketing purposes in cooperation with carefully selected partners and in compliance with data protection regulations.

  8. Changes to the GTC

    Pink Box AG reserves the right to amend these GTC at any time without giving reasons. Pink Box AG will notify the user of any changes to the GTC by email to the last email address communicated to Pink Box AG. If the user does not object to the validity of the new GTC within two weeks of notification, the amended GTC shall be deemed to have been accepted by the user. If the user objects to the validity of the new GTC, the contract with Pink Box AG will end and the user's profile and all data will be blocked. Pink Box AG will inform the user in the notification of his right of objection and the legal consequences of an objection.

  9. Final provisions

    Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The contracting parties undertake to replace an invalid provision with a valid provision that comes as close as possible to the economically intended meaning and purpose of the invalid provision. This applies accordingly in the event of contractual loopholes.

  10. Place of jurisdiction

    The ordinary courts in Zug shall have exclusive jurisdiction for all legal disputes arising from this contract.
